Did you know that in a court of law, a corporate body can be found guilty of killing a person? The Corporate Manslaughter and Corporate Homicide Act 2007 states that a corporate body can be found guilty of killing a person if it can be proved that the death was as a result of the company’s senior management failing to ensure the safety of its employees.

What could this mean for my company? An organisation convicted of this offence can receive a fine of which there is no upper limit.  In 2005 Transco was fined £15 million for health and safety breaches that resulted in an explosion in Lark Hill in 1999 and there are plenty of other examples of huge fines being given on conviction of corporate manslaughter or corporate homicide. This is one route you definitely don’t want to take your business down.

You might also receive a publicity order.  This requires the organisation convicted to publicise the facts of its conviction and certain details of the offence as specified by the courts.  The courts can also set a remedial order requiring the company to address the cause of the fatal injury to ensure it can never happen again.

So, as you can see, complying with health and safety laws and ensuring policies are properly implemented is absolutely vital and not something to be left on the back burner.
